All services are subject to the following terms and conditions:

The Client

I acknowledge that The Funeral Photographer(“the Photographer”) cannot accept responsibility for the photographic coverage of the funeral service and related function if the details provided by the Client either orally or using the order form on this site are incorrect. I accept in the event I have not provided the Photographer with the Order Form then the Photographer cannot be held liable for any missed photographic coverage due to incorrect information.

I undertake to provide a family contact person to the Photographer whose role is as follows
(i) To contact the Photographer prior to the funeral service and explain special events during the funeral service or afterwards, such as a piper piping the hearse;
(ii) To gather key family members for family portraits at appropriate times during the funeral service and related function;
(iii) To identify persons of particular significance to the deceased so that all key attendees are photographed;
(v) To supply eulogy, obituary or other text for inclusion in the book;
(vi) To provide wording for book cover such as “The funeral of John Smith held at St Mary’s Church Strathfield in accordance with his wishes 7 March 2009” within seven days of being requested by the Photographer; and
(vii) To approve the book’s wording and all photographs within seven days of being requested by the Photographer.

I accept that due to the sensitive nature of a funeral, the Photographer reserves his right to exercise discretion and not take photos in a particular situation even though I may have requested photos of the situation.

I acknowledge that copyright remains with the Photographer.

I acknowledge that the availability of the book(s) is dependent on the assistance of the family contact person and that it will generally be available within four weeks from the date the family contact person has approved the book’s wording and photographs and payment as been received in full.

I agree that to avoid disruption to the photographic coverage and to allow the Photographer to fulfill its contracted duty, other photography by family and friends during the funeral and related services and functions will be at the discretion of the Photographer.

I agree that a telephone order requires written confirmation and payment before the order can be processed and that all reasonable traveling costs, freight and postage will be paid by the Client; all travel within metropolitan Sydney will be at the Photographer’s cost.

I acknowledge that the Photographer will not retain photographic images of the funeral service and related function for more than six months after the date of the funeral.

I acknowledge that the Photographer has no control over the environment in which the funeral photo book(s) are kept once they are delivered to me and that the book(s) have limited life expectancy when exposed to strong and prolonged light sources.

I agree that payment must be made in full within fourteen days of the invoice date, that the photographer is not under any obligation to license the images to the Client until such time as all outstanding invoices have been paid, that all orders remain the property of the Photographer until full payment has been made and that no future orders will be processed until all previous orders have been paid in full.

The Photographer

The Photographer has the right to nominate a photographer with appropriate skills to photograph the funeral and related functions.

The book(s) are manufactured to a very high quality and the Photographer unconditionally guarantees for a three-year period that the book(s) will maintain their appearance if handled appropriately and with due care.

The Photographer will carry out this assignment with due and professional diligence. The Photographer shall not be liable for its complete performance of the assignment where there are events beyond its control. Elements beyond the Photographer’s control include industrial disputes, civil disturbances, equipment failure and weather conditions which may inhibit or prevent the Photographer from completing in whole or in part this assignment.

It is agreed that the liability of the Photographer shall be limited to a refund of any money paid under this agreement which shall be in full and final satisfaction of any damage or loss suffered.
